Did You Know That... Massachusetts has a so-called Dog Bite Statute which makes the owner or keeper of a dog responsible for any injuries the dog might inflict upon a person. The only exceptions to the law are for injuries caused to persons who are trespassing or teasing, tormenting or abusing the dog. Many times questions arise as to whether the owner is responsible when a dog "playfully" jumps a person and causes that person to fall and become injured. A past case in Massachusetts involved an injury to a person who was walking downstairs and tripped and fell over a dog that was lying at the top of the stairs. The court, in that case, held that liability under the law arises only for a dog's "active conduct" such as biting or jumping.
